Roberto Alomar Sued for Having Unsafe Sex While Allegedly Having AIDS

Roberto Alomar (seen to the right in April of 2008) received a shocking set of legal papers Tuesday, as his ex-girlfriend, Ilya Dall, filed a lawsuit in state and federal court alleging that Alomar had unprotected sex with her while knowingly infected with AIDS. As a result of these claims, she is suing the likely Hall of Famer for $15 million.

The New York Daily News initially reported the lawsuit, which is absolutely packed with -- whether they are valid or not -- shocking allegations. Included are claims that Alomar was raped as a 17-year-old, suffered from erectile dysfunction and has been inflicted with HIV and AIDS for some time now.

The sexually-specific allegations (as gleaned from The Smoking Gun's copy of the lawsuit) revolve around Alomar engaging in unprotected sex with Dall from 2002 through December of 2005; Dall's suit also alleges that Alomar received a positive HIV result on February 6, 2006, stemming from a January 27, 2006 test.

Alomar's camp took a decidedly strong stance against the claims.

His lawyer, Charles Bach, would not say whether Alomar is HIV-positive. "We believe this is a totally frivolous lawsuit. These allegations are baseless," Bach said. "He's healthy and would like to keep his health status private. We'll do our talking in court."

Sandy Alomar, the second baseman's father and a former major leaguer as well, said it was the "first time" he'd ever "heard of that" and that his son's ability to keep such an illness secret for that long would be surprising.

Alomar himself could not be reached for comment.

If this is true, then Alomar should be charged with attempted murder! This is a very sad story and an even sadder way of ending a life.

if i was the umpire this a$$-hole spat on , i belive I TOO would be tested for hiv . and if positive would jump on the band-wagon too. then let his friggin lawyer say the law suits are " frivolous .

If he didn't test positive until 2006 and they broke up in 2005 then how did he supposedly "knowingly" do this? She just wants to get paid from the relationship and hopefully she knows not to have unprotected sex again.

Yeah right another white privilidged woman want to sit around and get taken care of (hate all you want I'm white and it is the truth). If she really that dumb and ignorant to know a man exihbit all these signs and she still slept with him then she deserves what she got although she's lucky she didn't catch anything. I'm so sick of stupid gullible women period who will believe any man who claim he is clean especially when not in a serious relationship. There is no excuse for this stupidity in today's world of information.

I'm with the guy above. If the positive test is dated Feb. 2006 and he stopped having sex with her in Dec. 2005, where's the "knowingly"?

That said, why is she having unprotected sex with anyone, especially for several years, without having both had an STD screen?

I've heard that Roberto Alomar had the HIV virus for sometime now, however, if this woman "knowingly" had unprotected sex then she should also be responsible for the outcome of such relationship. I totally agree with the person who wrote that she is doing this just for the money. Many a times these women go to bed with famous/rich people just so that they can somehow try to get money out of that realtionship. She has no case in neither court. Next time she'll think about it twice before having unprotected/wild sex.

i believe it. .. I had a cousin who passed away from AIDS and the guy she slept with passed away like a year or more before she was diagnosed with AIDS and the only reason she got tested is because she found out what he died of so it is possible that if they broke up in 2005 and she said the test was 2006 than they would have to prove he was HIV positive which i'm sure will come out in court.

You aren't diagnosed with being HIV and having AIDS, they are two separate diagnoses, though HIV can, and proabably will eventually lead to AIDS. Get the facts straight before reporting, someone can't have both.
